根据加拿大公民法（Citizenship Act)的规定， 要想取得加拿大公民资格需具备以下条件：

1. 18周岁以上；

2. 是加拿大永久居民；

3. 申请公民之前的4年中，必须在加拿大居住至少3年（1095天）；

4. 能够用英语或法语交流；

5. 了解加拿大；

6. 了解作为加拿大公民的权利和义务

但是在实际的案件审理中， 加拿大的案例法(Case Law)表明，即使申请人达不到居住时间的要求，只要能够证明申请人把加拿大作为他 "有规律的，正常的，或通常的"    （"regularly, normally or customarily"）居住地，申请人就应该被认为是满足了居住时间的要求。在重要的案例 Re Papadogiorgakis 中，法官 Thurlow 写到：

 It seems to me that the words "residence" and "resident" in the Citizenship Act are not strictly limited to actual presence in Canada throughout the period....A person with an established home of his own in which he lives does not cease to be resident when he leaves for a temporary purpose whether on business or vacation or even to pursue a course of study. The fact of his family remaining there while he is away may lend support for the conclusion that he has not ceased to reside there.

通过案例法，居住时间达不到要求的申请人可以根据他同加拿大在经济，工作，家庭，社会活动，社区建设，等等一系列联系，证明他把加拿大作为了"有规律的，正常的，或通常的"居住地，并且努力融入加拿大的社会，经济生活，建立一个以加拿大为中心的生活方式 ，从而满足成为加拿大公民所需的居住时间的要求。
